A statutory suppression expired allowing Finnigan to be named for the first time as the South Australian MP charged with child pornography offences.

Finnigan pleaded not guilty in the Adelaide Magistrates Court to obtaining child pornography and five counts of taking steps to obtain access to child pornography between August 2010 and March 2011.

Prosecutors dropped the remaining eight charges, which had been laid as alternatives to the major indictable charges.

Magistrate Simon Smart ruled Finnigan had a case to answer.

Finnigan’s lawyer Michael Abbott QC sought a judicial review of that ruling, which was granted in October.

He had applied for a new suppression order on Finnigan’s identity but was unsuccessful.

Finnigan had been sitting as an independent MP since his resignation from Cabinet in April 2011.

Premier Jay Weatherill said he was shocked a former colleague had been charged with such awful crimes and called for Finnigan to resign.

Judicial review into charges begins

The judicial review sought by Finnigan’s lawyer, Mr Abbott, began at the South Australian Supreme Court.

Mr Abbott argued the prosecution could not prove there was an identifiable victim under the age of 14 and therefore the major indictable charges were invalid.

Finnigan’s trial to be reconsidered

A judicial review saw the full court of the Supreme Court rule in Finnigan’s favour, with Chief Justice Chris Kourakis finding he had been denied the chance to make submissions about aspects of the evidence.

Justices Tom Gray and Ann Vanstone agreed with the ruling, but said they did so for different reasons to those presented by the Chief Justice.

The court set aside the order committing Finnigan for trial in the District Court and sent the matter back to the Magistrate’s Court for further consideration.

As a result of the Supreme Court’s finding, Finnigan’s name was suppressed again for a short time.

The suppression was lifted by Chief Magistrate Elizabeth Bolton on February 12 after media organisations made an application for a publication order.

The Director of Public Prosecutions (DPP) laid fresh child pornography charges against Finnigan.

The DPP replaced the court file with two charges, one an aggravated count of obtaining access to child pornography and another count of taking a step towards obtaining access to child pornography.

Finnigan’s lawyer Mr Abbott told the Adelaide District Court he had filed an application to have the proceedings against the MP permanently stayed.

The application, which was obtained by the ABC, sought the stay on the grounds that prosecutors cannot prove vital elements of the offences and that they amount to an abuse of process.

Finnigan also sought a trial by judge alone and Mr Abbott applied for extra time to elect a trial without a jury, in case the stay application was unsuccessful.

Opposition questions Finnigan’s record in Parliament

The South Australian Opposition said Finnigan’s contribution in State Parliament had been inadequate since he was charged with child pornography offences.

The Opposition said 1,000 days had passed since Finnigan was arrested and resigned as a Government minister.

Shadow attorney-general Stephen Wade said records showed Finnigan had made just two speeches in Parliament since then and has asked no questions nor moved any private member’s motions.

He said Finnigan has been entitled to almost $1 million in salary, superannuation, staffing and other entitlements and has a duty to do his job.

A judge was asked to consider whether prosecutors were abusing the legal process by laying new child pornography charges against Finnigan.

The Adelaide District Court was told prosecutors replaced Finnigan’s last remaining charge with two – accessing child pornography and attempting to access child pornography, both charges non-aggravated.

Finnigan’s lawyer said the new charge of attempting to access child pornography is based on the same evidence as the charge earlier stayed so was destined to fail.

An application to permanently stay the attempting to access child pornography charge, was later rejected by Judge Steven Millsteed.

Finnigan trial begins four years after his arrest

Finnigan’s trial in the District Court began after four years and about 30 court hearings.

Prosecutor Mark Norman said Finnigan had entered terms into a search engine which took him to several child pornography websites that he clicked on.

He said this happened both in December 2010 and April 2011, and the terms involved “obvious connotations of child sex”.

Only one witness was called to give evidence at the trial – e-crime expert Robert Taylor who is employed by SA Police.

The court was closed for Mr Taylor’s evidence, which was considered “sensitive” because the websites were being shown.

On the third day of the trial, which was being held behind closed doors, the court released a statement of 27 facts agreed on by both the prosecution and defence.

One of the statement of facts said that before December 2010 and “thereafter until his arrest”, Finnigan regularly used his Sony and Apple laptops “to view legal pornography online”.

The trial was initially listed to run for five days, but ran over six days.

MLC Bernard Finnigan has quit politics, effective immediately, after being found guilty of a child pornography charge.

Finnigan issued a public statement through his lawyers saying he had given “careful consideration to the views expressed by my colleagues, family and friends”.

“In addition, I am conscious of the need to protect the integrity of the judicial process, which has not yet concluded, and the dignity of the Parliament,” Mr Finnigan said.

Finnigan has been under pressure from South Australian Premier Jay Weatherill to quit politics after being found guilty this week by the District Court of obtaining access to child pornography.

His lawyers had argued he could not be removed from the Legislative Council until he was convicted and sentenced.

“It is not my wish to promote further political uncertainty or to provoke some form of constitutional dispute over the power of the Legislative Council to expel a member,” Mr Finnigan said.

“In the circumstances, I have determined that the most appropriate course is to resign from the Legislative Council, with immediate effect.”

Finnigan said he tendered his resignation with the Legislative Council president Russell Wortley this afternoon.

It’s a scandal of unparalleled proportions the resolution was either the resignation as we’ve seen or ultimately the difficult process of expulsion, so it’s the appropriate end to the process.

Opposition upper house MP Rob Lucas

“I sincerely hope that both politicians and the public will respect the need for the judicial process to be concluded without undue public comment or interference,” his statement said.

He said he would not be making any more statements until sentencing was completed.

Mr Weatherill said the “proper course of action had now been taken”.

On Wednesday he called it an “absolute disgrace” that Finnigan still held a seat after being found guilty.

Opposition Upper House MP Rob Lucas said Finnigan’s resignation meant he had avoided becoming the first MP to be expelled from the South Australian Parliament.

“He saw the writing on the wall that if he didn’t resign he was going to be expelled on Tuesday by way of a motion,” Mr Lucas said.

“I think it’s sad for the institute of Parliament that it’s been dragged through this particular sordid process,” Mr Lucas said.

“It’s a scandal of unparalleled proportions the resolution was either the resignation as we’ve seen or ultimately the difficult process of expulsion, so it’s the appropriate end to the process.”

Concerns over Michael Brown as new member

With Finnigan’s seat in the Legislative Council now vacant, it is up to Labor to select a new member.

It is believed the seat will go to former Labor state secretary Michael Brown.

But Mr Lucas raised concerns about Mr Brown’s record, including the 2010 campaign.

The District Court criticised Labor’s strategy of handing out how-to-vote cards labelled “put your family first” as dishonest.

“Michael Brown comes to the table with soiled hands from the dirty tricks campaign of 2010, which was the subject parliamentary inquiries and various other committees, so if he’s to be their nomination, there’ll be some interesting debates I suspect and discussions, both with the media and in the Parliament,” Mr Lucas said.

Finnigan was arrested at his Sefton Park home in April 2011 and charged with accessing child pornography between December 2010 and April 2011.

He was found guilty for obtaining access to child pornography but acquitted of a second charge of attempting to obtain access to child pornography.

Sentencing submissions for Finnigan are expected to be made on November 30.

South Australian independent MP Bernard Finnigan has been found guilty of obtaining access to child pornography.

Key points:

Finnigan was arrested at his Sefton Park home in April 2011 and charged with accessing child pornography between December 2010 and April 2011.

Finnigan’s lawyers have asked the judge not to record the conviction now, but rather for that to be decided during sentencing.

The judge agreed to defer that issue until sentencing.

The trial, which began in April this year, was heard by Judge Steven Millsteed alone.

Finnigan was also acquitted of a charge of attempting to obtain access to child pornography.

He was repeatedly heckled by the public as he left court accompanied by his legal team.

On Tuesday afternoon, Finnigan said in a statement he would carefully consider his future.

Earlier this afternoon, my lawyers wrote to the president of the Legislative Council advising him of the outcome of my trial before Judge Millsteed in the District Court.

I will take time over coming days to give careful consideration to his Honour’s judgement.

It is my intention to absent myself from further sittings of the Legislative Council pending sentencing and a decision as to whether to appeal.

In the circumstances, it is not appropriate that I make any further comment at this time.

Before Judge Millsteed delivered his verdict in front of a packed public gallery he warned onlookers that they would be removed from the court if they caused a disturbance.

Finnigan’s lawyer Michael Abbott QC was not at the hearing, but had others from his legal team in attendance.

In his 89-page judgment, Judge Millsteed said he was satisfied beyond reasonable doubt that Finnigan manually entered the search terms into Google rather than it being automatically completed or produced by a “pop up” link.

He also said it was “improbable” that a person would key in such a search term and not proceed with the search by clicking on at least one of the results.

Judge Millsteed said while he could not find beyond reasonable doubt that all of the search terms were necessarily referable to child pornography, he was able to conclude that some of them were.

“The nature of the words he used suggest that his intention was predominately directed at young teenagers,” Judge Millsteed said.

“On my findings he did so with the intention of viewing child pornography.”

Judge to consider lifting suppression on search terms used

But he said the prosecution had failed to prove its case on the second count.

After delivering his verdict Judge Millsteed said he would further consider whether to lift the current suppression order on the search terms Finnigan used.

“It is not a difficult exercise for members of the public to potentially access child pornography if they wish,” Judge Millsteed said.

“Indeed there may be a cogent argument that publication of this material puts people on notice that use of these sorts of search terms puts them in serious jeopardy.”

A finding of guilt in respect of this type of offence is not compatible with a person continuing to serve as a Member of the Legislative Council

The case has been adjourned to November 30 for half a day of sentencing submissions.

Finnigan was re-elected as a Labor MLC (Member of the Legislative Council) at the 2010 election, but resigned as a Government minister in early 2011 to sit on the cross bench.

He continued to sit in the Legislative Council as an independent and would be due to face voters in the 2018 election.

In the wake of the guilty verdict, Attorney-General John Rau said he believed the public expected Finnigan would not continue to serve in the Legislative Council.

Mr Rau said he expected the Legislative Council would deal with Finnigan’s parliamentary tenure next Tuesday.

“A finding of guilt in respect of this type of offence is not compatible with a person continuing to serve as a Member of the Legislative Council,” Mr Rau said.

“Exactly how the matter unfolds from here will ultimately be determined by the Legislative Council itself and I expect that when they convene next Tuesday one of the matters that they will be dealing with very urgently will be consideration of the effect of this judgement.”

UPPER House MP Bernard Finnigan turned up at Parliament for a ridiculous self-indulgent cameo today….The fat pervert selfish in the extreme, not even giving the government the respect to stay around for more than a few minutes

 The former leader of the Government in the Upper House appeared at 4.35pm and left after eight minutes at 4.43pm. He resumed his seat on the back bench on the Government side on the chamber, but did not make any comment or contribute to the debate.

Mr Finnigan refused to explain his absence for seven straight sittings to reporters and would not say if he intended to keep his seat. He walked slowly to the carpark before driving off.

Under parliamentary rules, MPs are automatically dismissed from office if they miss 12 consecutive sitting days without being granted leave, traditionally allowed in instances of sickness.

Mr Finnigan missed seven sitting days and was required to attend before June 23 to avoid being sacked, and forfeiting his $130,000 base salary, access to an office and staff as well as subsidised car and phone use. His appearance yesterday means he can remain absent until September 14.

He only needed to attend Parliament today long enough to have his appearance noted to win another 12-sitting day reprieve from expulsion.

THE disgraced politician at the centre of child pornography allegations made his first court appearance at Adelaide’s Magistrates Court today!

The man, who has yet to plead to multiple counts of child pornography offences, arrived at court just before 10am.

He was accompanied by his lawyer Michael Abbott, QC, and his solicitor Dominic Agresta.

The trio walked silently through a large media pack and entered the court. Oh don’t they wish they could say more my friends…(feel free to send me anonymous emails!!!)

Section 71A of the Evidence Act (1929) bans the media from publishing any evidence tendered, or submission made, in the Magistrates Court relating to an alleged sex offence.

Courts sheriff officers ejected the reporter from the court, and banned him from the building for 24 hours.

“That’s up to Mr Finnigan and those matters will be dealt with at a later stage,” Mr Rann said. Opposition education spokesman David Pisoni said Labor must explain why Mr Finnigan resigned as minister.

“When Mr Finnigan was announced as minister 72 days earlier there was great fanfare,” Mr Pisoni said. “The Premier has been silent on the reasons for Mr Finnigan leaving the ministry – South Australians deserve an explanation, why did we see such a sudden departure of Mr Finnigan?”

PREMIER Mike Rann says he is shocked by reports of an MP being charged with serious criminal offences involving alleged possession of child pornography.

The MP at the centre of the allegations has been identified as a Labor MP but a six-paragraph statement released by Mr Rann makes no mention of the MP’s political affiliations.

“For legal reasons, no person, including me as Premier, is at liberty to reveal the identity of the person, the subject of the allegations, or to disclose any information through which others may infer the identity of the person,” Mr Rann said.

“It would be against the law for me to comment on the allegations as the matter is now before the courts.

“I believe that any potential witnesses with any evidence or information about these allegations must co-operate fully with police.”

The MP was taken to the City Watchhouse on Wednesday night, charged with four child pornography offences and later released on police bail.

He will appear in Adelaide Magistrates Court on May 20.

Detectives said their investigation was continuing.

Under SA law he cannot be identified until his committal, unless he gives his consent.

He returned home earlier today but had not spoken to the waiting media outside.

Politicians from both sides say they are shocked by the allegations.

Police said the arrest was the result of the Sexual Crime Investigation Branch’s ongoing “Operation Decimate”, which targets people who use the internet for child exploitation-related offences.

The maximum penalty for possessing child pornography in South Australia is five years in jail for a first offence. The maximum penalty for an aggravated offence in seven years in jail.

Section 63 of the Criminal Law Consolidation Act 1935 says that an aggravated offence includes an offender knowing that the victim was aged under 14 at the time, or the offence being committed in the company of one or more other people.

It is believed several laptops were seized from the MP’s suburban home.

Turmoil swept state political circles as details of the incident emerged.

There were reports that police visited the MP’s office at Parliament House but this was denied by the presiding officers, who have to give permission for police to enter the building.

Legislative Council President Bob Sneath said he had not been approached by police and Speaker Lyn Breuer said she had not been contacted by police.

Ms Breuer said she was “certainly concerned about the issue”.

Labor and Liberal MPs were in shock last night and few were prepared to talk about the incident. Many were asking the media for details.

A spokeswoman for Opposition Leader Isobel Redmond said she could not comment.

It is understood the MP’s home was raided on Tuesday afternoon and police spent 24 hours analysing the contents of a computer.

Yesterday, they went to the MP’s office and seized another computer for analysis. Last night, police returned to the MP’s house.

One officer emerged from the house about 7.35pm and went to a police car. He then carried what appeared to be a tape back into the house. At 7.55pm, two detectives wearing gloves searched a car parked in the driveway.

They examined the boot and under the seats before returning to the house. Police left the house at 8.10pm carrying several evidence bags containing compact discs and a mobile phone and the house was shut and left in darkness.

It is further banned from naming any person charged with an offence, and must not identify anyone alleged to be a victim.

The act defines a sex crime as “any offence involving sexual exploitation or abuse of a child, or exploitation of a child as an object of prurient interest”.

The act says alleged offenders can only be named once they have entered a plea – be it guilty or not guilty – to the charges, and have been remanded for either sentence or trial.

The MP is due to appear in court again on May 20, when a magistrate will organise a schedule for the case.

The DPP replaced the court file with two charges, one an aggravated count of obtaining access to child pornography and another count of taking a step towards obtaining access to child pornography.

Finnigan’s lawyer Mr Abbott told the Adelaide District Court he had filed an application to have the proceedings against the MP permanently stayed.

The application, which was obtained by the ABC, sought the stay on the grounds that prosecutors cannot prove vital elements of the offences and that they amount to an abuse of process.

Finnigan also sought a trial by judge alone and Mr Abbott applied for extra time to elect a trial without a jury, in case the stay application was unsuccessful.

Opposition questions Finnigan’s record in Parliament

The South Australian Opposition said Finnigan’s contribution in State Parliament had been inadequate since he was charged with child pornography offences.

The Opposition said 1,000 days had passed since Finnigan was arrested and resigned as a Government minister.

Shadow attorney-general Stephen Wade said records showed Finnigan had made just two speeches in Parliament since then and has asked no questions nor moved any private member’s motions.

He said Finnigan has been entitled to almost $1 million in salary, superannuation, staffing and other entitlements and has a duty to do his job.

A judge was asked to consider whether prosecutors were abusing the legal process by laying new child pornography charges against Finnigan.

The Adelaide District Court was told prosecutors replaced Finnigan’s last remaining charge with two – accessing child pornography and attempting to access child pornography, both charges non-aggravated.

Finnigan’s lawyer said the new charge of attempting to access child pornography is based on the same evidence as the charge earlier stayed so was destined to fail.

An application to permanently stay the attempting to access child pornography charge, was later rejected by Judge Steven Millsteed.

Finnigan trial begins four years after his arrest

Finnigan’s trial in the District Court began after four years and about 30 court hearings.

Prosecutor Mark Norman said Finnigan had entered terms into a search engine which took him to several child pornography websites that he clicked on.

He said this happened both in December 2010 and April 2011, and the terms involved “obvious connotations of child sex”.

Only one witness was called to give evidence at the trial – e-crime expert Robert Taylor who is employed by SA Police.

The court was closed for Mr Taylor’s evidence, which was considered “sensitive” because the websites were being shown.

On the third day of the trial, which was being held behind closed doors, the court released a statement of 27 facts agreed on by both the prosecution and defence.

One of the statement of facts said that before December 2010 and “thereafter until his arrest”, Finnigan regularly used his Sony and Apple laptops “to view legal pornography online”.

The trial was initially listed to run for five days, but ran over six days.

Finnigan found guilty of one charge

A judge finds Finnigan guilty of obtaining access to child pornography but not guilty of attempting to obtain access to child pornography.

Sentencing submissions will be heard on November 30.

      • Robbo, I’m not sure if you have any info on this case that I don’t. If you have details of the allegations, I’d *love* to hear them. I am most curious. What exactly was allegedly found on the computers? How many images and video clips? And what did they contain? (Child nudity? Teen porn? Images of prepubescent kids being molested by adults?)
        As to people being found not guilty in child porn cases, it happens quite often, actually. The conviction rate is approximately 65%, I believe.
        How do people dispute the case? Here are some issues that can arise:
        (1) Whose were the images? If several people share a computer, this can be tricky to prove. If the computer was used by the accused alone, obviously this issue is clear.
        (2) Was the material accessed “intentionally” (i.e. was the person aware of the nature of the site they were visiting, or the images they were downloading)? If the police find a large collection of material, clearly the answer is “yes”! You can’t get hundreds of kiddy porn files on your computer by accident (unless your computer has been hijacked by a “zombie network”, but that would be quite uncommon in child porn cases). If the charge merely relates to a single visit to a child porn site, or a small number of files downloaded on P2P, there can legitimately be issues raised in this regard. Material on P2P networks isn’t always clearly labeled (a file on gnutella can have endless different names) and it is possible to stumble on a site containing illegal material when looking for legal porn. For example, entering “teen porn” in a search engine can result in both legal and criminal results. (I’m talking about a real case, btw – this actually happened).
        (3) Are the persons depicted actually underage? In the case of prepubescent kids, there no issue in this regard! But with images of teens, this issue can potentially be tricky. Absent a birth certificate, it’s not easy to prove that the “teenager” is legally underage. (Not sure how the law works in SA. In NSW, if the filename or title implies that the participant is underage, e.g. “15yo getting f___ed” this is taken as prima facia evidence that this is the case).
        (4) Is the material actually child porn? If it depicts a kid being molested by an adult, no question! Mere nudity can however raise questions in this regard. Remember the infamous Henson case? Nude, yes, child porn no – at least as far as the law is concerned.

        So, in summary, yes – it is possible for an accused to be found not guilty. Some cases are clear-cut, but others are less so. So can you fill me in on any details of this case? What exactly was found on Minister Finnigan’s computers?

        Oh, and do you know any details about the case against ABC presenter Andy Muirhead? He plans to plead not guilty. I’d love to know more.

  18. To be fair, at least one of those Labor politicians, Milton Orkopolous, was found not guilty and actually took the lady, or ladies who were accusing him of rape or whatever, to court for defamation and what not.

    So while some of those are guilty, I think it’s also appropriate to also do a little research before hand instead of throwing around peoples names who have been proven innocent in a court of law.

      but, as you say, to be fair – and in the interest of completeness – I’ll add that when I went to check my memory against the online record, I found that, despite compelling circumstantial evidence and testimony, and the fact that he didn’t offer much in the way of defense, Mr Orkopolous’ mate, Patrick Roughan, was found not guilty of abusing a nine year old girl. Oh and of course Bob Collins overdosed to avoid the numerous victims and witnesses waiting to see him in court. Bill D’Arcy Keith Wright and Neville Hilton were also convicted.

        She had already been granted a default judgment against Orkopoulos, who was jailed for at least nine years in May 2008 for child sex and drugs offences.
        The judge made the damages order against the Speaker and Orkopoulos, but not against the state of NSW.
        The issue of legal costs will be heard at a future date.

I think it was found witnesses was coached by “the department” Luckily for Tom Easling, he had financial back up and was found not guilty. I then tried a different tact using a different name to see if the blog will accept it. Some blogs were published hours after I put them up. I am trying to get across that the Labor Government were behind the Easling arrest, and now similar allegations are against a member of the same labor Government. I see that as karma!

    • Hi Gary, so you are defending him by saying he was maybe researching at home and in his office? This is a World Wide problem that is being tackled around the world with Co operation from task-forces all around the work. databases of known porn sites, subpena credit card companies etc to catch them out signing up for this filth etc. But to say it is for research, well That is a cop out anyone can use. I am going to write a book about it etc etc. There is absolutely NO need for anyone to type that shit it to a computer and see it with their own eyes in the guise of research.       DCS (Dept for Corruptional Services) even spent taxpayer funds to install a camera in his cell, so he could be observed 24/7, as he was deemed a high suicide risk (kinda like the innocent children he defiled). It was a bit of an unwritten agreement that the officer response would be very slow, should he attempt something- a bit like “I was watching the wall, your Honour…”

I have a funny feeling that fat finny won’t do a minute inside for this. interesting to see Mr Abbotts extreme anger toward the media outside the court in the early days of fattys arrest , it reminded me of his agression toward them with Richard Brown . He does get protective doesn’t he [excuse sarcasm]. Now lets see, we had Richard Brown arrested but charges were dropped. We had Ric Marshall arrested, convicted and sentenced but he gets to ride his scooter around Parkside. We have Dr Woodards arrested and charged but the best we get is hope after a nolle prosequi is entered by the prosecution. At least somebody got Storen even if it was OS. I will be following the Pearce and Rozankowski cases with interest. just hope the media doesn’t drop of all of this like it did with Dr Woodards. Got a feeling that our system is just one big happy family.
