Gerard Baden-Clay Appeals against Murder Conviction


SLAIN Queensland mother Allison Baden-Clay’s life insurance payout will go to a legal trust while her husband awaits the appeal of his murder conviction.

Today, the Federal Court ordered the sum of Allison’s TAL Life Limited policy — worth more than $412,000 in 2013 — be paid to the trust of solicitors representing her father, the estate’s executor.

It will be held in the trust account pending the final outcome of Gerard Baden-Clay’s pending appeal of his murder conviction.

The life insurance policy was jointly held by Allison, 43, and her husband, Gerard Baden-Clay.

It was one of two that were frozen after Baden-Clay was charged with his wife’s murder in June 2012.

Last August, funds from a Suncorp Life and Superannuation policy that was worth more than $347,000 in 2013 were ordered to be paid to Allison’s father’s representatives.

Allison’s parents, Geoff and Priscilla Dickie, are caring for the couple’s three daughters.

Baden-Clay, 44, tried to claim the insurance shortly after his wife’s body was found on a creek bank at Anstead in Brisbane’s west in April 2012.

After he was charged, the Federal Court became involved and froze the funds pending the outcome of criminal proceedings.

A former real estate agent, Baden-Clay was found guilty last July of murdering his wife at their Brookfield home in Brisbane and dumping her body.

Details of their marital breakdown, financial troubles and Baden-Clay’s infidelities were laid bare during the four-week trial.

Baden-Clay is serving a life sentence and will be eligible for parole in 2027.

GERARD Baden-Clay was wheeling and dealing behind bars to gain up to $2 million if he’d been acquitted of murdering his wife Allison.

The day before the remorseless killer was found guilty, he bragged to prison guards he would soon be a free man.

And he was set to be a wealthy one too.

Baden-Clay would have walked out to a media deal of at least $600,000, negotiated by his family as he awaited trial.

He also would have collected up to $1 million from his wife’s insurance policies and $440,000 from selling a Gold Coast investment property he had owned with his wife.

Behind the scenes, TV producers flew up to Brisbane to woo the Baden-Clays with huge sums of money if he walked and talked.

WIFE-killer Gerard Baden-Clay is prolonging the agony of Allison’s family and friends, appealing his conviction just two days after being sentenced.

He claims the jury was “unreasonable” when they found him guilty of murdering his wife and that a “miscarriage of justice” had occurred.

The challenge will likely take more than six months to get to court.

Last night Allison’s family told of their anguish at the appeal.

“It’s been a difficult time for the family, just let her rest in peace,” one of Allison’s relatives said

Baden-Clay was condemned in court by Justice John Byrne for using his wife’s struggles with depression in an attempt to beat the murder charge.

Baden-Clay’s defence team of barrister Michael Byrne QC and solicitor Peter Shields filed the paperwork yesterday shortly before midday.

The appeal claimed a miscarriage of justice occurred because the jury should have been directed the presence of Allison Baden-Clay’s blood in her car was only relevant if the jury was satisfied beyond reasonable doubt it could only have got there from an injury that occurred on the night she died.

It also argued the trial judge should have directed the jury that they needed to be satisfied beyond reasonable doubt Baden-Clay took his wife’s body to Kholo Creek in order to use it as “post offence conduct going to guilt’’.

Baden-Clay’s legal team also claimed the judge should not have told the jury they could consider whether he had “attempted to disguise marks on his face’’ by making razor cuts.

Lawyers are given one month to lodge an appeal. It would then be listed for hearing in the Court of Appeal.

Appeal notices are usually subject to significant refinement before written outline of arguments are lodged closer to the hearing date.

When the matter makes it to the court, Baden-Clay will appear before a panel of three judges. His lawyers will outline why they believe the trial failed and the Crown will respond.

If he is successful, he could be acquitted or the case could be tried again.

Lawyers for Gerard Baden-Clay have filed an appeal against his murder conviction.

On Tuesday a Supreme Court jury found the 43-year-old Brisbane man guilty of killing his wife Allison in April 2012.

He was sentenced to life in prison, with a non-parole period of 15 years.

He has appealed against his conviction on four grounds, including that the verdict of murder was unreasonable, and that:

“A miscarriage of justice occurred because the jury should have been, but was not, directed that the presence of the deceased’s blood in a motor vehicle was only relevant if the jury was satisfied beyond reasonable doubt that the presence of blood was attributed to an injury sustained to the deceased’s body on the evening of 19 April 2012 or the morning of 20 April 2012,” the application reads.

“The trial judge erred in law in not directing the jury that they needed to be satisfied beyond reasonable doubt that the appellant placed the body of the deceased at Kholo Creek in order to use such a finding as post-offence conduct going to guilt.

“The trial judge erred in leaving to the jury that the appellant attempted to disguise marks on his face by making razor cuts.”

  2. I feel so sad what is happening to this blog. I don’t believe people aren’t on the blog due to withdrawal symptoms from the trial, the reason I say that is that there are 3 blogs that I know of seeking justice for ABC plus a fb page and I check all blogs out frequently and do see that the people we HAD on this blog are now on other blogs. I have to wonder ‘is there someone here trying to destroy this blog’ ??
    I miss RIP for Allison, moonraker, berleigh beach, Dan, Miss Marples, Ozmosis and many more of the regular posters that used to be 😦

      2. Robbo, there have been attempts to raise the issue previously re irritants. Some said ‘uh, what are you talking about’?; others said ‘so be it if we have lost a poster’; I suggested rather than chastising those responding to an irritant, that the irritant be given some lessons in social skills and respect. It has been a balancing act to try to not engage or add fuel to their fire. However, that was not always possible because of the strategically placed posts. I guess ‘divide and conquer’ is their motto and maybe people have just decided they didn’t need the crappola of some if it was pushing their buttons.

        I feel sad because it was a healthy on-line community but I guess there will always be someone trying to rain on the parade. Looks like they achieved their purpose here.

        Such a shame. At least we are all still living and breathing, unlike poor innocent Allison who forged ahead despite her handicap, her husband, and no doubt lived each day being mistreated by an irritant that became a danger, a murderer, a killer.

        A bully is a bully is a bully. If it is in their blood, there ain’t much hope in deconstructing and reconstructing them. Must be extremely sad and bitter individuals, infected with self-loathing.

    Circumstantial Evidence is evidence that relies on an Inference to connect it to a conclusion of fact- like a fingerprint at the scene of a crime.
    Definition of Inference from http://www.wikpedia.org, Inference is the act or process of deriving logical conclusions from premises know or assumed to be true.
    Definition of Direct Evidence from http://www.wikipedia.org, Direct evidence supports the truth of an assertion (in criminal law, an assertion of guilt or of innocence) directly, i.e., without an intervening inference.
    So GBC’S case was based only on circumstantial evidence, but circumstantial evidence is very powerful at proving a persons guilt, especially when it’s overwhelming as it is in GBC’S case, and as I like to say, Gerard Baden Clay is Guilty, and that’s a fact based on Circumstantial Evidence.

  4. The jury got it right! I was worried he was going to walk. The cops knew it from day one, I sometimes had my doubts but the prosecution led the jury across the line wonderfully!
    Well done!!

    Allison put him away. If it wasn’t for her scratches, her blood and the leaves in her hair, he would be a rich free man.

    “She would never ever in her life physically have had a fight with anyone. She would never have done that. So the fact she did that, and marked him, and he had to sit there and figure out a way to cover up those scratches, I am just so forever impressed by the strength that it took for her to do that. He, who controlled everything, couldn’t control her hand.”

    Do you know of any new publicly available info re GBC’s appeal? I’m guessing that it’s probably in a queue and it will be a matter of waiting x number of months (perhaps even longer ?) before the application reaches the first stage – an assessment of whether the grounds submitted hold water.

    Just want to add, thanks as always for your hard work. Despite all the recent comment wars on this thread, I’m sure plenty of readers continue to benefit from the blog in general and the GBC pages are a valuable source of info. I’ve personally been an avid reader throughout most of the GBC trial though have commented very little overall.. Commenters don’t by any means necessarily represent the majority of blog readers from what I understand.

  8. I hear Brisbane’s story bridge is being lit up with yellow lights in memory for Allison and many more who have suffered domestic abuse. How wonderful, I will have to get a photo of that

    Robbo has a special page for us all for 1st August, wear yellow for Allison day. Allison’s family say, if you don’t have anything yellow then wear something special, a new piece of jewellery or a new tie etc. Friday will be a very special day to so many and such a beautiful memory for Allison’s family, friends and all those who loved Allison.       1. Yes. Gerard simply just cannot restrain himself. One of the tell tale signs of a narcissist is a profound grandiosity and sense of entitlement. I know GBC’s dangerous levels of narcissism have been done to death on these pages already but I’ve found that I can calm my instinctual WTF, you effing arrogant acavity* response to his appeal by remembering that just because this ‘man’ has been exposed to the public as a murderer, a perverter of justice and a calculated liar and deceiver and subsequently sentenced to imprisonment for life, that doesn’t mean that he will now transform into a human man (give up the narcissism and feel remorse). I’ve been coming around to this way of thinking: The GBC appeal makes sense to me not because it may be statistically normative for x percentage of convicted murderers to appeal following conviction as a “matter of course”, but because it is normal for pathological narcissists to expend their energy maintaining their delusional self image as a matter of course. Gross entitlement and grandiosity are used towards this end. To me, this explains why the appeal was lodged immediately ( within 2 days) and why the grounds involve, at base, an unfounded, baseless and delusional questioning of the competence of the individuals who exposed the fraud who is GBC. Protection of self image drives it all.

        I am glad you talked about the yellow bridge…I have been thinking about it, the special yellow ‘Allison’ day and the idiocy of an appeal.

        I was fearful of posting as I had said I was going into blog retirement after the guilty verdict; thought everyone had left the building; and, I might be labelled as having a ‘mental health issue’, for not having ‘moved on’. Anyway, if I am contradicting myself:-), I just can’t understand the arrogance, cheek, stupidity, lack of respect for Allison and her family by GBC……
        How could he or his family even consider trying to start another wasted battle after the war is over? So many losses. Allison lost her life for heaven’s sake. Her children their mother, her parents a child, her siblings a loved sister and so the damage goes on and always will. Their attempts to convince themselves and others of ‘innocence’ have proven futile, dishonest, in very poor taste and downright inhuman. To my mind, it is nastiness personified, and continues to grow as Mr and Mrs Dickie, the children, her family have to continue to endure spiteful retaliation from the guilty. It just doesn’t make sense.
        It seems the Baden-Clay camp is a speck of dust in the whole of the universe and out of sync. I wonder what they will be doing on ‘wear yellow for Allison’ day?

        I am a little bit simple, but I find it difficult to believe that others in his family are not aware of exactly what happened that fateful night when Allison was murdered. Even more baffling to my little brain is that not one person with knowledge of events hasn’t had the need to spill the beans in an attempt to purge their souls (I thought I read somewhere they were a ‘Christian family) and show some sympathy and remorse. Do they have no conscience, and if that is so, is it a congenital abnormality. Alternatively, I wonder if the family has been born, bred, and nurtured within the Baden-Clay cult. I guess it would be more a Clay cult, wouldn’t it, because the Baden is a cosmetic facade?

        If I haven’t made sense, no problem:-). Writing is therapy and feel better for having moved some crap off my liver.

        I am just glad (and/or hopeful) the 3 young girls will have minimal contact with the whole family. Surely to goodness the murderer’s family wouldn’t fight for greater access. That would be criminal.

      I guess his sexual appetite will be well quenched in prison. Apparently condoms are freely available in male prisons.
      Really, is prison in reality a punishment: he has shown to ‘get on with business as usual’ (as said eons ago by a fellow blogger) under all circumstances, with prison being no different….so if he has been able to slip under the radar and carry out some real estate movement (granted, proceeds frozen – thank truck for that), is exhibiting arrogance towards other prisoners (who he might consider lesser than himself); has his heightened libido satisfied, 3 square meals a day, doesn’t have to mow the lawn or paint the premises, well……?

GBC thought it was OK to cheat on his wife, well it is NOT OK, same as a wife cheating on her husband, a husband or wife having a affair can never be morally justified, I never have or will cheat on my wife, why, because I believe in remaining loyal and having a affair is sociopathic behaviour in my opinion, affairs can never be justified, only in the sociopaths mind.

      Affairs happen all over the shop and I have heard that sex between consenting adults is legal but different people, different morals and values. I don’t think there are too many happy endings, so to speak, though with extra marital affairs.

      Can you spot the capacity for murder when choosing with whom you are having sexual relations? If we were all versed or wired in spotting narcissists and murderers and therefore avoiding them and the pain and destruction spread, it would be a sweeter world. Problem being the bastards sneak up on you and catch you in their nasty web. The mistress in this case helped weave that dangerous web and appeared to move freely to different partners. Allison kept the home fires burning and probably all the while trying to figure out an unfathomable situation, with the well-being of her girls the priority.

      I purposely said ‘her girls’ because it was her unconditional love and nurturing that one hopes sustains them through the tough times. Where was their father….certainly not at home being a decent husband and father? No, he was off bonking whatever he could find available.

But for some reason, I thought ‘I bet he is still cursing Allison’… I wondered about his thought processes at this time; how he would be spending his time (I heard a mention of him reading law books); whether he might be thinking 15 or 17 years would go by quickly.     The children are the victims in this, she has boys, what are learning from this?
    In a very early report I read TM had lost custody of her children, can anyone confirm this?

    1. Mmmm, wondering if that was the dishonorable Broos Flugg’s fone…. Remember he offered Gerred Bad-Lay-Clay accommodation, a phone and who can imagine what other possible services. Really, one’s mind just oggles and boggles at these kind gestures.

      Perhaps if he fails in life, he could set up ‘rooms for rent’ – murderers welcome. Oh I just remembered he has that flash apartment in the big fruit… I think we were paying him too well. Gosh, now he could sell that big fruit apartment and return the money to help subsidize GBC’s appeal considering his generosity.

  17. I still believe Gerard Baden-Clay will be acquitted. He is not a bad person but with bad circumstances in life which can happen to anyone. I also believe that the killing was not premeditate. He has no record of violence and had been a good provider to his family. People are so judgemental as they only know is to condemn people without looking/hearing at both sides of the stories. He and his family is in my prayers. I trust The Lord with all these trying times in his life. He will acquit one day. God Bless Him…

    If you wanted to clarify or explain further as to how you reached you views on GBC’s innocence, that would be interesting. I don’t share those views and there is a mountain high load of very reasonable evidence that supports this. Apart from that, I join TCR in suggesting, since you mention that you are praying, that you include Allison’s and GBC’s daughters in those, along with Allison’s parents who are now responsible for their care.

      The murderer made sure Allison lost her voice and he, and perhaps a few intimate others, are filled with demons, mistruths, dishonesty and couldn’t lie straight in bed.

    1. NO TCR…I look at it this way. No other suspects with a motive. This case has consumed us all and we made it much more complicated then it was when you take a few facts into place and leave all the rest alone.

      The trillion to one thing would be she somehow, lied to everyone that one day (she never was shown to lie) depressed and high as a kite after kissing kids goodnight with her phone disappearing off the face of the earth as well, going for a walk, jumping off a bridge, dead but climbing back above the water line, suffering no injuries blah blah blah. GBC business was going to win every lotto in the world and everything would be better and he would stop being a adulterer and lying coward….

I understand the BC’s EARLIER supporting Geeerrrrd because it seemed so circumstantial and if he was crying totally innocent, (I actually had my slight doubts at times). It’d be a huge head f*ck.         I certainly understand why people write Impact Statements and the need for the Judge to receive them, but delivering them in an open Court expecting everyone to stay and listen to them isn’t my cup of tea.

        People can and do make all sorts of claims in these types of untested statements and I don’t see the need for a parent to stay and listen to them. They’re already dealing with the fact that their son is going to Prison for ‘Life’.

If one of my family members was suspected of murdering someone, would I support them or abandon them, I would support them to a certain extent, but I would not say anything to the media, if they were convicted, I would go and visit them occasionally, not very often, although I wouldn’t abandon my family member.

When BR said victim impact statements aren’t his cup of tea, what I think BR means is that he would find it stressful to listen, or their is no point since justice has been served, overall BR posts rather factual statements, his facts are almost always right, and BR is a normal commenter like everyone else.

      1. Normally in the Supreme (or District) Courts the VIS are ‘handed up’ to the Judge and not read out in the open court.

        After-all, the purpose of them is to help determine sentence….same as any ‘Support Statements’ for the accused which also aren’t read out.

        So….I can understand why EBC chose to leave when this Judge decided to allow the VIS become a part of the public proceedings……and no ‘Support Statements’ were afforded the same treatment.

Changing the discussion, I haven’t read all the details of the Jenny Lee Cook case, but from what I’ve read, even though it’s bizarre, no screams were heard, no evidence of any struggle, no scratches or bruises on Paul Cook( although when a person murders someone, they might not always have any scratches or bruises) so I think it’s more likely to be a suicide, what do you think?

  23. I’m having a break from this website for a few days, a few days in my definition means, 2 days, or 3 days, or 4 days, or 5 days, or 6 days.
    After a while thinking about this case can get quite stressful and depressing, so I need to have a break from thinking about it for a few days.

Let’s say GBC did not have any scratches on him, Allison’s blood wasn’t in his car, he did not take his phone on and off the charger throughout the night, their was no evidence that he was awake throughout the night, he did not Google, Self Incrimination, he didn’t inquire about Allison’s life insurance policy after she was found, he told the police he had an argument with Allison and she went out for a walk to clear her head because she was stressed and upset, and he helped the police search for Allison, the police still might have charged GBC with murdering Allison and disposing of her body at the Kholo Creek Bridge, if that happened, he probably would have got acquitted of murdering Allison at his trial, but thank goodness GBC wasn’t that clever at covering up the evidence!

I didn’t get that comprehension from anywhere really, it’s just that most criminals by age 17 can’t write properly and are below average intelligence, the Average criminal writes like that, I have a friend who works in the Maryborough Correctional Centre and he said some of them write even worse that that, so I’m portraying GBC as the average criminal.

    Then after GBC’S appeal fails, if it does which I think it will, we can then forget about GBC for the next 15 years, although each year we will remember Allison on Wear Yellow For Allison Day, also known as Strive To Be Kind day, that was held on the 1st of August this year.

  27. The dust may have “settled”… However I still think about allison daily… her hurt and her pain for so many years.

    I hope GBC is being abused and tormented and manipulated in there. He deserves nothing less.

    I live in hope and satisfaction knowing those 3 girls are being given a better life without him in it.
